Should I represent myself or obtain the services of Crescent City Law for a DUI/DWI?

Representing yourself for a DUI is not advisable. Drunk driving is a highly intricate field with severe repercussions. For instance, a third DWI is considered a felony, and Louisiana can look back ten years at your previous DWI convictions. DWIs can impact both your insurance rates and driver’s license.

An attorney can meticulously scrutinize the case, challenge evidence, demand access to records related to breathalyzer calibration and maintenance, independently analyze blood samples, negotiate for reduced charges or sentences, and even secure expert witnesses for trial. They can also contest any administrative license suspension.

What defenses are there in a DWI/DUI case?

There are many potential defenses for a DUI case in Louisiana:

  • The prosecution must also prove that the defendant was driving.
  • Implied consent warnings.
  • “Under the influence”. The officer’s observations and opinions as to intoxication can be questioned.
  • Blood-alcohol concentration (BAC).
  • Testing during the absorptive phase.
  • The BAC must relate back in time from the test to the time of stop and arrest.
  • Regulation of blood-alcohol testing.

After DUI Arrest in Louisiana: What should I do now?

Contact Crescent City Law as soon as possible and prior to your arraignment if possible.

You were probably given a 30 day temporary license. You have 15 days to request an administrative hearing regarding the suspension of your license.

If you are represented by an attorney at the arraignment, you probably will not have to attend. At an arraignment, the court will enter a plea of not guilty on your behalf and give a date to return to court for a pre-trial conference or trial.

Suspension of Drivers License in Louisiana for DUI

If you are stopped for suspicion of DWI/DUI and refuse the breath test, your license will be suspended for one hundred and eighty days; if you are stopped for suspicion of DWI/DUI and take the breath test and the results show a .08 percent or higher, your license will be suspended for ninety days. If you refuse to submit to the test, your driving privileges shall be suspended for one hundred eighty days from the date of suspension on a first refusal. Additional refusals cause longer suspensions.

There Is A Warrant For My Arrest. Can You Help Me?

Yes and without turning yourself into jail. When a warrant is issued for your arrest, the law usually only requires you or someone on your behalf to appear before the court to answer for the warrant. It is difficult to quote an exact fee without some more information from you about your case, but in general our attorneys’ fees are between $200-$250.00 for a traffic ticket.
