DUI or OWI in Louisiana: What’s the Difference?

In Louisiana, the term DWI (Driving While Intoxicated) is commonly used instead of DUI. Some also refer to OWI (Operating While Intoxicated). Regardless of the terminology, the charges are governed by Louisiana Revised Statute § 14:98, which criminalizes operating a vehicle with a Blood Alcohol Concentration (BAC) of 0.08% or higher, or while under the influence of drugs or alcohol.

What Are the Financial Costs of a DUI?

The financial penalties of a DUI, alongside other consequences and jail time, can add up quickly. Let’s break it down by offense:

First Offense DUI (BAC between 0.08% and 0.15%)

  • Fines: $300 to $1,000
  • Jail time: 10 days to 6 months (possible probation)
  • License suspension: 90 days (or longer if BAC exceeds 0.15%)
  • Ignition Interlock Device (IID): Possible requirement
  • Alcohol safety education or treatment program
  • Court costs, fees, and insurance hikes

Estimated total cost could range from $4,000–$6,000 including fines, court fees, legal representation, and increased insurance rates.

Second Offense DUI

  • Fines: $750 to $1,000
  • Jail time: 30 days to 6 months
  • Mandatory community service
  • License suspension: Up to 2 years
  • IID required
  • Minimum 48 to 96 hours of jail time if BAC exceeds 0.15%

Estimated total cost could range $7,000–$10,000+

Third Offense DUI (Felony)

  • Fines: Up to $2,000
  • Jail time: 1 to 5 years (1 year mandatory)
  • License suspension: 3 years
  • Court-ordered substance abuse treatment
  • Vehicle seizure possible

Estimated total cost could range from $12,000–$20,000+

Additional Penalties

1. High BAC Enhancements (Over 0.15% or 0.20%):

  • BAC 0.15%–0.19%: Minimum 48–96 hours jail
  • BAC 0.20% or higher:
    • $750 to $1,000 fine
    • 48 hours to 96 hours jail (1st or 2nd offense)
    • IID for 12 months
    • License suspension up to 4 years

2.Refusing a BAC Test: Implied Consent Law (§ 32:661)

Refusing a breath, blood, or urine test results in:

  • 1st refusal: 1-year license suspension
  • 2nd refusal (within 10 years): 2-year suspension
  • 3rd refusal: Criminal penalties and longer suspensions

Refusal penalties are separate from the court process and can be enforced even if your DUI case is dismissed.

Speaking with an experienced DUI attorney in Louisiana can help you understand the full scope of your charges, explore possible defenses, challenge the legality of the traffic stop or chemical test, and potentially reduce or dismiss the penalties you’re facing.

Underage DUI Penalties in Louisiana

Louisiana has zero tolerance for underage drivers (under 21) with a BAC of 0.02%–0.08%. Under RS § 14:98.6, penalties include:

First Offense

    • Fine: $100–$250
    • Jail: 10 days to 3 months
    • License suspension: 180 days
  • Probation may include:
    • 32 hours community service
    • Substance abuse treatment
    • Driver improvement course

Second Offense

    • Fine: $250–$500
    • Jail: 30 days to 6 months
  • Probation may include:
    • 80 hours community service
    • Substance abuse treatment
    • Mandatory IID installation

If your minor is convicted with DUI, the consequences can affect not only their driving privileges but also their academic future, employment opportunities, and record

At Crescent City Law, we work with families to minimize the long-term impact, advocate for alternatives like diversion programs or probation, and help young drivers avoid life-altering consequences from one mistake.

Driver’s License Suspensions

DUI-related license suspensions in Louisiana can come from:

  1. The court (after a conviction)
  2. The Department of Public Safety (after arrest, even without a conviction)

Suspension periods:

  • 1st offense: 12 months
    2nd offense: 24 months
    3rd offense: 36 months

Suspensions for test refusal or failure may run concurrently (at the same time), not consecutively.

Probation and Alternative Sentencing

In some cases, a judge may suspend part of a jail sentence and place the offender on probation. Conditions often include:

  • Substance abuse evaluation
  • Community service
  • Minimum jail time served
  • Installation of an IID

Probation is not an option if:

  1. You had a DUI within the same year
  2. A child under 13 was in the vehicle at the time of arrest

Working with a seasoned criminal defense lawyer in Louisiana can help you secure probation instead of jail time, especially for first-time offenders or cases with mitigating circumstances.

Hidden Costs of a DUI in Louisiana

Beyond court and legal fees, there are several hidden or long-term costs:

  • Insurance premiums can double or triple
  • Loss of income from missed work or termination
  • Towing and impound fees
  • Costs for license reinstatement
  • Travel restrictions or visa denials due to a criminal record

A DUI conviction can also affect your housing, scholarships, and professional licensing.
